Graham H. Davies (U.K.) Ltd. v. Marc Rich & Co. Ltd. - Court of Appeal (Ackner Neill and Glidewell L.JJ.) - 30 July 1985

Whether time for appointment of arbitrators should be extended under section 27, Arbitration Act 1950

On 31 October 1983 G. Ltd. agreed to buy goods from M. Ltd. shipment to take place between November 1983 and March 1984. The sellers failed to ship the total contractual quantities. In April 1984 the buyers accepted bills of exchange drawn by the sellers in respect of such goods as had been supplied. In June 1984 when the bills were presented for payment they were dishonoured. On 28 June 1984 the sellers issued a writ claiming the sums due under the bills.
