Whether time-charterer of vessel damaged in collision entitled to recover economic loss from negligent third party

The vessel Ibaraki Maru was damaged as the result of a collision with the vessel Mineral Transporter and had to undergo repairs. The Mineral Transporter was wholly to blame for the collision. The time-charterers of the Ibaraki Maru sued the owners of the Mineral Transporter for damages representing (a) wasted hire payments which they were obliged by the charter to pay while the vessel was under repair, and (b) the lost profit they would have earned under a voyage fixture which had had to be cancelled as a result of the vessel having to undergo repairs.
