Contract - Whether charterparty concluded by exchange of telexes

The defendants owned the vessel Intra Transporter . The plaintiffs entered into negotiations with the defendants to voyage-charter the vessel from the Argentine to Dubai. Numerous telexes had been exchanged between the parties. At an advanced stage of the negotiations, and after various points had been agreed, the plaintiff’s telexed that they would arrange for Argentine flag waiver, but said that they would need a signed charterparty for that. The defendants said they would draw up a charterparty on the Gencon form with their usual rider clauses and some additional clauses, and would mail it to the defendants for signature.
