Charterers load less cargo than required by charterparty - Whether owners entitled to damages in addition to deadfreight

The charterparty provided that the vessel should load a minimum of 40,000 tons of crude oil. In fact the vessel only loaded 34,447 tons. The charterers had paid deadfreight on the difference, but the charterparty provided for demurrage at 285% on the worldscale rate plus 2,000 tons. If 40,000 tons had been loaded that rate would have amounted to $5,925 per day, whereas the rate for the amount actually loaded was $4,750 per day.
