Deck cargo lost during bad weather - Whether shipowners liable
The vessel
Tilia Gorthon
was carrying a deck cargo of timber across the Atlantic in October 1979 from Canada to England. She encountered storm force
winds, during the course of which most of the deck cargo was washed overboard. The plaintiff cargo owners claimed damages
against the defendant shipowners in respect of the lost cargo.
