Full indemnity costs awarded after unsuccessful application to remove arbitrator

In November 1972, B. Ltd. sold 1,320 tonnes of U.S. soyabean meal to S. Ltd. for shipment between April and September 1973. The contract was affected by the 1973 U.S. soyabean meal embargo. S. Ltd. brought arbitration proceedings against B. Ltd. under the GAFTA rules. An award was published in April 1974 ordering B. Ltd. to pay S. Ltd. $65,129 plus interest and costs. B. Ltd. gave notice of appeal and a GAFTA Board of Appeal was constituted, of which Mr. S. was a member.
