Trade Union Act 1984 - Whether ITF conduct unlawful because no secret ballot held

One of the questions raised in this case was whether the threatened conduct by ITF would also be unlawful for want of a ballot under sections 10 and 11 of the new 1984 Act. The problem was that ITF was a federation of affiliated trade unions and under its present rules could not hold a ballot which complied with the 1984 Act. Counsel argued that accordingly the Act did not apply to ITF.
