Crew engaged as watchkeepers on vessel’s arrest - Whether entitled to lien for unpaid wages

The vessel Prince George was arrested on 3 September 1983. She was ordered to be sold by the Court on 24 February 1984. The purchase monies were subsequently paid into Court. The claimants were two members of the crew. On the day the vessel was arrested they were engaged as watchkeepers. They had never been paid by the owners. On 13 January 1984 the Continental Bank of Canada, the intervenor, took over management of the vessel. The claimants were kept on.
