Mabanaft GmbH v. Consentino Shipping Co. SA (The Achillet) - Q.B.D. (Com.Ct.) (Lloyd J.) - 10 May 1984

Arbitration - Dictum of Sherlock Holmes approved in application to set aside Reasoned Award

The vessel Achillet was chartered to carry a cargo of gasoline and gasoil from Rotterdam to West Africa. She loaded, 12,200 tons of gasoline at one terminal then shifted to the Matex terminal across the river where she loaded 6327 tons of gasoil. She proceeded to Tema, in Ghana, where she discharged the gasoil and all but 2450 tons of the gasoline. The receivers complained that the gasoline was contaminated. The 2450 tons of gasoline was brought back to Antwerp where it was reprocessed. The cost of the reprocessing was $248,833. The return freight amounted to $300,000.
