NYPE form - Whether Hague Rules incorporated - Effect of Inter Club Agreement

The issue in this case was whether arbitration proceedings had been commenced in time by charterers against shipowners. Cargo damage had occurred in February 1981. The arbitrator was appointed in September 1982. The questions were (a) whether the Hague Rules (and therefore the one year time limit) was incorporated in the charterparty and (b) whether the incorporation of the Inter Club Agreement clause affected the position.
