Arbitration - Sealed offer

The question before the Court was whether a pending arbitration between the parties had been compromised in correspondence between their solicitors. Prior to the hearing the respondents’ solicitors (Constant & Constant) sent telexes to the claimants’ solicitors (Ince & Co.) offering to pay the sum of U.S. $140,000 including interest and costs. The offer concluded with the words:
