Practice - Judgment given at “ex parte” hearing without all issues being considered - Whether judgment should be set aside

The plaintiff owners of the vessel Satya Kamal time-chartered her to P. In the course of that time charter the vessel loaded timber in Finland under a number of bills of lading of which the defendants became holders and the receivers of the cargo. The defendants were an Iraqi government trading agency. After the vessel had loaded the cargo and had sailed on her voyage the time charterers went into liquidation and hire ceased to be paid.
