The Kota Pahlawan - Singapore High Court (Wee C.J., Lai & Chua JJ.) - 13 May 1982

Practice - Whether writ may be amended to substitute correct party as plaintiff

Universal Union Trading Co. Pte. Ltd. of Singapore (the shippers) shipped a cargo of automotive spare parts on board the vessel Kota Pahlawan for carriage from Singapore to Indonesia. The goods were to be delivered to the order of the Chase Manhattan Bank or their order. In the event, the bill of lading was endorsed to C. V. Agung of Indonesia (the consignees), who took delivery of the goods. The one-year time limit under the Hague Rules applied to the contract of carriage. This period (as extended) expired on 10 April 1980.
