Gatoil Anstalt v. Omennial (The Balder London (No. 2)) - Q.B.D. (Lloyd J.) - 8 July 1982 - Practice - Whether leave to appeal required

Cross-undertaking as to damages - Issue estoppel

By a time-charter dated 20 April 1979 Gatoil chartered the vessel Balder London from Omennial (disponent owners). On 21 April 1980 Omennial gave notice of withdrawal for non-payment of hire. On 24 April Gatoil obtained an injunction restraining Omennial from withdrawing the vessel. Gatoil gave a cross-undertaking as to damages.
