Marine Steel Ltd. v. The Govt of the Marshall Islands (The Militobi) - High Court of New Zealand (Barker J.) - July 1981

Doctrine of sovereign immunity inapplicable to Marshall Islands

The plaintiff, a New Zealand ship repairer, agreed to carry out certain repair work to the vessel Militobi , owned and operated by the defendant government. The plaintiff carried out the work at Auckland but claimed that he had not been paid the full amount owing to him. He now applied ex parte for leave to serve proceedings outside New Zealand.
