Mareva injunction - Conditions imposed on plaintiff - Protection of innocent third parties generally

In Searose Ltd. v. Seatrain (U.K.) Ltd. - LMLN 34 - certain conditions were imposed upon the granting of a Mareva injunction to prevent it bearing harshly on a third party bank. In the present case, the relevant asset was not a bank account but cargo or bunkers on board a vessel within the jurisdiction. Mr. Justice Robert Goff imposed similar terms on the plaintiff in order to protect a third party port authority which might otherwise have suffered financially as a result of the injunction.
