A.J. Bekhor & Co. Ltd. v. Bilton - Lord Justice Stephenson, Lord Justice Ackner and Lord Justice Griffiths - C.A. - Feb. 6, 1981
Mareva injunction - Ancillary orders - Defendant ordered to disclose details of his assets within the jurisdiction - Court of Appeal
The Court of Appeal have decided that the power of the High Court under s.45(1), Supreme Court of Judicature (Consolidation)
Act 1925, includes a wide power to grant a Mareva injunction whether or not the party subject to the injunction is domiciled,
resident or present within the jurisdiction. There was also an inherent power to make such ancilliary orders, including orders
for discovery, as are just and convenient to ensure that exercise of the
Mareva
jurisdiction is effective to achieve its purpose.
