Motion to stay English proceedings refused - No dispute between the parties

A bill of lading issued by carriers acknowledged shipment aboard Banglar Mita of 132,000 bags of skimmed milk in apparent good order and condition. At Chittagong, the discharge port, the carriers instructed Captain Raham to survey certain defective packages which had been set aside by the stevedores for inspection. They were found to be torn and water damaged. The Controller of Movements and Storage certified that 361 bags were damaged and 646 bags were short landed.
