Whether arbitration agreement repudiated

A time charter provided that any disputes should be referred to three arbitators in London, and it was common ground that the arbitration agreement was governed by English law. The plaintiff charterers, Gulf, sought a declaration that the arbitration agreement had been discharged by the delay of Jadranska, the defendant owners. They also sought an injunction, damages, and if necessary, an order under s.1 Arbitration Act 1950 granting leave to revoke the appointment of the arbitrator.
