NYPE Form - Delivery and counting of hire - 26/80

The charter-party provided for the ship to be placed at the disposal of charterers “on taking inward harbour pilot X (name of port) any time day or night . . .” The last sentence of cl.5 (time to count) of the printed form was deleted. The ship anchored in the roads before time could commence counting under the printed cl.14, but because no berth was available it was not until seven days later that a pilot boarded and took the ship in. The owners claimed that hire started 00 01 hours on the cl.14 date: the charterers said it started only when the pilot boarded.
