Whether owners entitled to withdraw vessel

The dispute, which came before the Court on a special case stated by two arbitrators, arose out of a New York Produce Exchange charter for a min. 9/max. 12 months. The owners purported to withdraw the vessel from the charterers’ service for short payment of hire. Clause 5 provided that the owners could withdraw the vessel unless hire was paid monthly in advance and the approximate amount of hire was paid in advance for the last half month, the balance to be paid day by day should that payment not cover the actual time.
