Leave to serve writ out of jurisdiction - Lloyd’s Average Bond - Proper law

This was an appeal from the granting of leave to serve a writ out of the jurisdiction under R.S.C., O.11, r.1(1)(f)(iii) - where the action brought was on a contract which by its terms, or by implication, was governed by English law. The contract was contained in a Lloyd’s Average Bond which had been signed on behalf of the plaintiffs and defendants.
