A shipbuilder?s structural shop was said by OHSA not to comply with its standards. Regulations issued by the Secretary of
Labour limited OHSA regulations to maritime work on navigable waters, including dry docks, graving docks and marine railways.
The Court held that the failure of the Secretary to include structural shops required that OHSA shipbuilding standards should
not apply to them. The test the Court applies is what the Secretary of Labour said, not what he intended.
