Speed and consumption claim - Effect of current - Whether master in breach of duty to proceed with utmost despatch

On 12 November the vessel was fixed for a time charter trip from delivery Nagoya (Japan) and thence from the United States/Canada West Coast to China with an intended cargo of potash. The fixture terms were recorded by way of an e-mail recap and based on logical amendments to the terms and provisions of a previous fixture between the two sides on an amended NYPE charter form with rider clauses.
