Practice - Service out of jurisdiction - Claim brought by widow of chief engineer under Fatal Accidents Act and as executrix - Meaning of "damage" in CPR 6.20(8)(a) - Forum conveniens

The claimant was the widow of the chief engineer of the vessel Maysora who had died whilst working on board the vessel in Egypt. The claimant, in her own right and as executrix of her husband's estate, claimed against the master of the vessel ("the first defendant") in negligence, and against the owners and managers of the vessel in negligence and for breach of the deceased's contract of employment.
