Logistec Stevedoring Inc v Amican Navigation Inc - Federal Court (Trial Div)(Lemiux J) - 21 June 2001

Agency - Stevedoring firm seeking outstanding charges for stevedoring services - Whether party ordering services contracted as agent only or as agent for disclosed principal

The plaintiff stevedores sought to recover from Amican Navigation Inc (“Amican”) $240,382 for stevedoring services performed in the loading and stowing of (1) military vehicles and bags of flour onboard the vessel Cosmos in Montreal, and (2) bundled onboard the vessel Fernando Pessoa in Halifax. Both vessels had been time-chartered by Pegasus Lines SA (“Pegasus”). Amican was Pegasus’s general agent in Montreal, as well as being agents for other shipping lines.
