Transocean Liners Reederei Gmbh v Euxine Shipping Co Ltd (The ‘Imvros’) - QBD (Com Ct)(Langley J) - 9 March 1999

NYPE form as amended - Deck cargo lost overboard as a result of negligent stowage carried out by charterers’ supercargo - Whether shipowners under overriding duty to intervene to prevent vessel sailing in unseaworthy condition

The vessel Imvros was chartered on the NYPE form as amended for one time charter trip (minimum duration 70 days). The vessel loaded a cargo of sawn timber which was stowed both above and below deck. The loading and stowage of the cargo was carried out under the directions of the charterers’ supercargo. The lashing of the cargo was carried out by the crew.
