Limitation of liability - Whether decree of limitation can be obtained before liability is established

The barge BOS 400 was being towed by the tug Tigr from the Congo to Cape Town pursuant to a charter which was subject to English law and jurisdiction on Towcom terms. On 26 June 1994 in stormy weather the barge was lost while under tow.
