Wasted costs order - Whether solicitors acting for client in unsuccessful application for leave to appeal should be ordered to pay the respondent’s wasted costs

On 21 February 1997 the Court of Appeal refused an application by the plaintiffs (Marflet) for leave to appeal against an order by Morison J on 3 October 1996 dismissing their motion against the defendants (Effjohn) in arbitration proceedings in which Effjohn were claiming substantial sums pursuant to a joint venture agreement.
