Vessel seized under Canadian Customs Act after heroin found onboard - Vessel released from seizure on provision of letter of undertaking by vessel’s insurers - Court holding that shipowner and mortgagee wholly unaware that vessel was used to convey drugs into Canada - Whether shipowners and insurers entitled to return of letter of undertaking

The first plaintiffs were the owners of the vessel Hoegh Mary , an oceangoing container ship registered in Greece. The second plaintiffs were insurers of the vessel.
