The plaintiff cargo interests chartered the vessel
Marina Di Alimuri
on the Gencon form for the carriage of “bulk harmless humus [i.e. peat moss] stowing maximum 55 cubic feet per metric ton”.
The charterparty required the vessel to proceed to one safe berth in Sept-Iles, Province of Quebec, to load a cargo of 25,000
metric tons, 10% more or less in owners option. The cargo was to be delivered to Port Everglades, Florida.
