Les Industries Perlite Inc and Others v The Owners of the “Marina Di Alimuri” and Others - Federal Court (Trial Div)(Nadon J) - 8 December 1995

Cargo claim - Vessel damaged when loading peat moss cargo - Whether vessel unseaworthy - Whether peat moss cargo dangerous - Whether shippers liable for damage to vessel even though dangerous nature of goods was unknown

The plaintiff cargo interests chartered the vessel Marina Di Alimuri on the Gencon form for the carriage of “bulk harmless humus [i.e. peat moss] stowing maximum 55 cubic feet per metric ton”. The charterparty required the vessel to proceed to one safe berth in Sept-Iles, Province of Quebec, to load a cargo of 25,000 metric tons, 10% more or less in owners option. The cargo was to be delivered to Port Everglades, Florida.
