Whether Arbitration claim time-barred by reason of one year time limit under US COGSA

The vessel Tbilisi was chartered under a Texacotime 2 timecharter. The charterers alleged that during the discharge of cargo at Guaymas, Mexico on 14 December 1992, parcels of jetfuel lead-free gasoline and diesel oil became comingled and contaminated due to the ship’s negligence. The charterers withheld $530,320 from outstanding hire to cover their claim for damages.
