Valley Towing Ltd v Celtic Shipyards (1988) Ltd and Others (The ‘Sea Cap XII’) - Federal Court (Trial Div) (John A Hargrave Prothonotary) - 31 July 1995

Limitation action - Whether plaintiff entitled to stay of all pending proceedings on payment of limitation fund into court

On 11 May 1995 the Sea Cap XII , a tug owned by the plaintiff, was proceeding up the north arm of the Fraser River with the barge Seaspan 619 in tow. The barge struck and damaged the premises of the defendant Celtic Shipyards. Other parties also suffered damage to equipment and facilities.
