Dole Fresh Fruit International Ltd v MV “Kapetan Leonidas” - Appellate Division (Corbett CJ, Grosskopf, Smalberger and Van Den Heever JJA and Nicholas AJA) - 29 March 1995 (reported at 1995 (3) SA 112 (AD))

Definition of “associated ship” - Associated ship must be owned by a company in which all the shares are controlled or owned by the same person who controlled or owned the shares in the company which owned the ship concerned

The plaintiffs arrested the vessel Kapetan Leonidas in Durban in order to obtain security in respect of a maritime claim to be pursued in arbitration proceedings in London against Saful Navigation Inc, which was the owner of the Chios Clipper . The plaintiffs alleged that the Kapetan Leonidas was an “associated ship”of the Chios Clipper . The Kapetan Leonidas was owned by Boothia Maritime Inc.
