Global Traders v “MV Guijiang” and Others - High Court (Mainur Reza Chowdhury J) - 19 January 1995

Admiralty practice - Plaintiffs arrested vessel alleging breach of bill of lading contract for failure to deliver cargo of cement - Whether arrest should be set aside on basis that bills of lading were fraudulent.

The plaintiffs filed suit against numerous defendants, including the vessel Guijiang , for recovery of Tk 12,300,000/- equivalent to the balance of the price of cement not delivered to the plaintiffs by the vessel Guijiang . The plaintiffs obtained an order for the arrest of the vessel.
