[2019] EWHC 2658 (Comm), Queen’s Bench Division, Commercial Court, Andrew Burrows QC (sitting as a High Court Judge), 10 October 2019
Procedure – Anti-suit injunctions – Service out of the jurisdiction – Consequential orders – Costs – Indemnity costs – Actions by a party out of the norm leading to costs on indemnity basis – Vexatious and oppressive
This was the decision of matters consequential upon a judgment dated 22 August 2019 wherein the first claimant, Clearlake, had been granted interim anti-suit injunctions to prevent the defendant Xiang Da’s letter of indemnity claim from proceeding in Singapore. The second claimant, Gunvor, had been granted an interim anti-suit injunction to prevent Xiang Da’s tortious misrepresentation claims against them from proceeding in Singapore. The claimants now sought orders for service and costs.
