Marine insurance

24.1 Introduction

In China, the marine insurance legislation is included in the Chinese Maritime Code 2025 (hereinafter, the CMC 2025).1 Chapter XIII of the CMC 2025 is concerned with marine insurance contracts. It consists of 42 articles (arts. 240–82) in six sections: General Provisions; Conclusion, Rescission and Assignment of Contract; Obligations of the Insured; Liability of the Insurer; Loss of and Damage to the Subject Matter Insured and Abandonment; and Payment of Indemnity. Marine insurance is governed by the relevant provisions of the CMC 2025; where the CMC 2025 is silent, the relevant provisions of Insurance Law apply.2
