Chief Constable not vicariously liable

Whilst off duty, a police constable, wearing his police uniform and in his own car was approached by a first aider from a nightclub, who had expressed his concern over an intoxicated person who was then taken to the car. The officer said he would take the person to the police station. However, over a period of hours he raped and indecently assaulted the claimant.
