No liability for council over window locks

The case involved a four year old child who fell out of a first floor window. The council had refused to fit window locks on the grounds of fire regulations. After the accident, the council fitted a safety catch, which the original judge said would have prevented the accident. The claim was made on the basis of common law negligence.
