Dangers of e-mail in insurance contract litigation

E-mail is the “Achilles heel” of insurance contract litigation, according to a market briefing, “Discovery and Privilege in the Digital Age” , hosted by the International Underwriting Association. Dennis Wade, a founding partner of insurance law firm Wade Clark Mulcahy, told an audience of London company market professionals that insurers and reinsurers might be risking costly claims litigation simply through the everyday use of e-mail.
