Collective conditional fee agreements

The Court of Appeal ruled that in a case where the claimant’s litigation was funded by a third party under the terms of a valid collective conditional fee agreement, the claimant was under a legal obligation to pay the costs incurred under the agreement. The claimant could therefore recover the costs from the defendant without infringing the indemnity principle.
