Road traffic accidents and contributory negligence
Haines v Talbot [2026] EWHC 2130 (KB)
A recent High Court claim has given rise to consideration of liability and contributory negligence in an unusual road traffic
accident. The claimant was inexperienced as a driver, but had made a serious error when replenishing the oil in her car, and
the judge took the opportunity to extend the basic principle established in 1971 in Nettleship v Weston [1971] 2 QB 691, a
case well-known to law students.
