Contract of affreightment - Failure by owners to perform declaration - Whether subsequent performance of later declaration constituted delayed performance of earlier declaration

By a Contract of Affreightment dated 21 May 2020 the owners, Transatlantica, agreed to carry fertiliser for the charterers, EuroChem, from Sillamae, Estonia to ports in Brazil and North America in the period 15 May to 15 November 2020. Three shipments were agreed, with a fourth to be carried out at the option of the charterers.
