An introduction to construction law of delay in Singapore and Malaysia

Introduction

32–001 Malaysia1 and Singapore are former colonies of the British Empire and members of the Commonwealth; as a consequence the common law of England and Wales (the common law) is the genesis and in essence, the construction law in both Malaysia and Singapore, subject, however, to contrary local statute and case law. In Malaysia, the Civil Law Act 19562 expressly incorporates common law and equity as part of Malaysia

as at 7 April 1956, subject to local statute and case law.3 In Singapore, the Application of English Law Act 4 also received the common law, English Statutes and equity into Singapore, as at 12 November 1993, save where there exists contrary local statutory and case law.5
