Other counter-measures against wrongful foreign proceedings

13.01 General

The most direct method of preventing foreign litigation, which can be shown to involve the commission of a legal or equitable wrong, is to obtain an anti-suit injunction, considered in the previous Chapter. However, if for some reason the court declines to grant injunctive relief, or if the respondent ignores the injunction, an alternative, or fall back, remedy, taking the form of an action for compensation for the wrong in question, may be available. The first part of this Chapter therefore examines the bringing of proceedings to obtain compensation for loss caused by wrongful litigation.
