Wages and masters' disbursements lien

5.1 Introduction

5.1.1 Concept

The seafarers’ lien has been called the “sacred lien”. 1 It is accorded high priority in dividing up the proceeds of the res following a judicial sale 2 . However, unless some duty or obligation falls within the concept of wages or disbursements (or remuneration) as the case may be, no maritime lien can arise in any of the jurisdictions being considered. So in terms of maritime liens, it is critical to establish whether something does fall within that concept or not.
