Carriage of goods - Time bar - Whether claim for security constituted "suit" - Cargo carried on deck - Hague-Visby Rules

The defendant owners were the owners of the vessel Taikoo Brilliance. The claimant was the holder of four bills of lading issued by the owners in respect of a cargo of New Zealand pine logs carried by the vessel from New Zealand to Kandla, India. The bills provided that disputes were to be resolved in arbitration in London. Two of the four bills specified the amounts of the cargo that were carried on deck.
