Good news for disability insurer

However, in another case against UnumProvident, a California court has significantly reduced the terms of the original judgment. The court found that the insured was residually disabled and that the evidence was insufficient to find that he was totally disabled. The court ordered an 83% reduction of the original punitive damage amount of US$30mn, and ordered a significant reduction of the emotional distress damage award from US$125,000 to US$15,000. The court said that the evidence of emotional distress demonstrated nothing more than transitory emotions and that a significant reduction was warranted.
