7.1 Background
A right has no force if it cannot be enforced. Plaintiffs in civil litigation often face the risk of not receiving compensation, even if they win their case. While the absence of security does not diminish a claimant's likelihood of winning the case in court, it can significantly impact the enforceability of the claim. The risk is particularly acute in maritime claims, where enforcement may face various challenges.
