Sea Master Special Maritime Enterprise and Another v Arab Bank (Switzerland) Ltd (The Sea Master) [2022] EWHC 1953 (Comm) (Mr Justice Picken) – 25 July 2022

Arbitration – Bills of lading – Misdelivery – Parties to arbitration clause in bill of lading – Scope of arbitration clause relating to counterclaims by shipowner – Arbitration Act 1996, section 67

Sea Master was the registered owner of the vessel Sea Master. The vessel was chartered to Agribusiness on the Norgrain 1989 form on 25 April 2016 for a voyage carrying grains from one or two Argentinian ports to up to three safe ports in Morocco. Arab Bank provided finance to Agribusiness for the purchase of the cargoes.
